IN MARK / Legal
The general terms for using our website and working with IN MARK.
Last updated:
These Terms & Conditions describe the use of the IN MARK website and the general framework for engaging our services.
Project-specific details are set out in the proposal, quotation or service agreement accepted by the parties. Where an agreed project-specific provision differs from these general terms, that provision takes priority for the relevant service, subject to applicable law.
For questions about these terms, contact info@inmark-eg.com.
IN MARK provides professional services including website development, automation, marketing and branding.
The scope, deliverables, fees and estimated timeline for each engagement are agreed with the client before work begins.
Website descriptions and examples provide general information. Submitting an enquiry or requesting a proposal does not, by itself, create a paid service contract.
Payment amounts, schedules and any advance payment requirements are set out in the relevant proposal, quotation or service agreement.
Additional work or changes to the agreed scope may affect fees and timelines. These changes will be confirmed with the client before the additional work proceeds.
Third-party costs, such as hosting, software subscriptions or advertising spend, will be identified in the project agreement or approved separately by the client.
If an agreed payment becomes overdue, IN MARK may pause the affected services after notifying the client and allowing a reasonable opportunity to resolve the outstanding payment. Any resulting changes to the delivery schedule will be communicated.
Successful delivery depends on timely cooperation, including access to relevant materials, accounts, information, feedback and approvals.
Clients are responsible for ensuring that materials they provide are accurate and that they have the necessary rights or permissions for their intended use.
If requirements change or necessary information or approvals are delayed, the parties will discuss any reasonable adjustments to the delivery schedule or scope.
Revision arrangements, acceptance criteria and ongoing support are determined by the relevant project agreement.
Clients may request to cancel a project or ongoing service by contacting info@inmark-eg.com. Any notice period or project-specific cancellation arrangements will be set out in the relevant agreement.
When a service is cancelled, any final payment or refund will take account of the work completed up to cancellation and any previously approved third-party costs that cannot reasonably be recovered.
Where advance payments exceed the amount properly due, the remaining balance will be refunded. IN MARK will explain the calculation and confirm the arrangements with the client.
If IN MARK is unable to complete an agreed service, we will discuss an appropriate resolution with the client, which may include a revised delivery arrangement or a refund for the unprovided portion of the service.
These provisions do not limit any cancellation rights or remedies available under applicable law.
Website content may include material belonging to IN MARK, its clients or other rights holders. Displaying a project, logo or other asset does not transfer ownership of that material.
You may view the website and use downloads for their stated purpose. Other uses remain subject to the relevant permissions and applicable law.
Ownership and usage rights for project deliverables, source files and other materials are determined by the relevant service agreement.
Third-party assets, software and platforms remain subject to their applicable licences and terms. Any necessary licensing arrangements should be addressed as part of the project.
An engagement may involve external services such as hosting providers, advertising platforms, CRM systems or software integrations.
Account ownership, subscriptions, access and related responsibilities are determined by the project agreement and the applicable provider terms.
External providers may change their features, pricing or availability. Where a change affects agreed work, IN MARK will discuss its impact and any proposed adjustments with the client.
Any additional third-party charges requiring client approval will be communicated before they are committed.
Project objectives and any specific performance commitments are set out in the relevant agreement.
Examples, estimates and forecasts are illustrative unless expressly included as contractual commitments. Marketing performance and business outcomes can be affected by factors such as market conditions, budgets, competition, platform changes and client implementation.
This does not remove IN MARK’s responsibility to deliver the services and commitments agreed with the client.
Please use this website lawfully and respect the rights of others.
Our Privacy Policy explains how personal information shared through the website and related enquiries is handled.
Where an engagement involves handling personal information on a client’s behalf, any additional data-processing responsibilities should be addressed in the relevant agreement.
Read our Privacy PolicyIf you have a concern about the website or an engagement, contact info@inmark-eg.com with the relevant details so that we can discuss an appropriate resolution.
Any project-specific dispute arrangements are set out in the relevant agreement. Applicable legal rights and remedies remain available.
Nothing in these terms is intended to remove rights or responsibilities that cannot lawfully be excluded.
The date at the top of this page identifies the latest revision of these general terms.
An update to this page does not, by itself, change an existing service agreement. Changes to an ongoing engagement follow the process agreed by the parties.
